COMPLAINANT AARON FRENKEL, from Israel, citizen of the Republic of
Israel, represented by attorney at law Ivan Kusalic from Zagreb
REQUEST FOR REMOVAL OF A PART OF ELECTRONIC PUBLICATION DUE TO STATING
OF UNTRUE FACTS
Dear Mr. Peratovic,
On July 16th, 2010. on website domain (blog) http://peratovic.blog.hr a post
(blog) was published, which is under your editorial responsibility. The stated
blog (post) called “Corruption and Justice“ starts with the description of the
alleged lobbying undertakings by the former president of the Republic of Croatia
Stipe Mesic. Mr. Aaron Frenkel is described as the lobbying project manager in
Croatia and is described as the world renown arms dealer.
“Mesic’s other golf project is located in the south of Croatia and run by Aaron
Frenkel, known in Croatia as the husband of Maja Brinar, the former assistant to
Minister or Economy in Racan’s administration, and oil dealer, but better known
in the rest of the world as arms dealer suspected of money laundering.“
A claim that Mr. Frenkel is an arms dealer is untrue and represents slander, that
in the harshest way possible causes harm to Mr. Frankel’s dignity, honor and
reputation.
The same post claims that Mr. Frenkel is the key figure of the affair and "game"
in Poland, in which a certain person was arrested, and he is involved in some
"shady business".
This is a known case in Poland, which started with the arrest of an entrepreneur and
a lobbyist, as well as a member of the Polish jet-set called Marek Dochnal. The main
figures in the affair beside from Kwasniewski and Dochnal were Aleksandar Schneiderand
Aaron Frenkel, with the polish subsidiary of Frankel’s company Loyd’s Investment. In
this affair, we are talking about millions, secret accounts in Switzerland, shady
business as well as Monaco: as a living destination of both Schneider and Frankel.
A claim that Mr. Frenkel is a figure in the stated affair is untrue and represents slander, that in the harshest way possible causes harm to Mr. Frankel’s dignity, honor and reputation.
It is further on stated in the article that Mr. Frenkel, as the current Croatian
consul in Jerusalem has become the star of the international arms dealing
scandal. It is also stated that this arrested gentleman is Mr. Frenkel’s business
partner and that all of the businesses of arms delivery by Mr. Frenkel are under
investigation in Romania, Azerbaijan and Kazakhstan.
Back in 2005, a year after marrying Maja Brinar, the current Croatian consul in
Jerusalem has become a star of the international arms dealing scandal on the route
Romania-Israel-China-India.
The detectives of the most elite Israeli police squad arrested a partner of Aaron Frenkel
(šefa IAI-ja – Mosha Keret) due to involvement in the shady business with the duo
Frenkel-Aviram: the purchase of the plane Iljušin, plans for the delivery of the plane
to Phalcon Chana (stopped by USA) so it ended up in India. Investigation covers all
projects of arms dealing by Frenkel and Aviram in Romania, Azerbaijan and Kazakhstan.
All stated claims are untrue and represent an insult and slander that
causes harm to Mr. Frenkel’s reputation and honor.
In the same post located on the homepage of the blog http://peratovic.blog.hr a
photograph of Mrs. Maja Frenkel, Mr. Frenkel and the President of the Republic of
Croatia Mr. Ivo Josipovic was published, ending the article with a conclusion
that the President of the Republic of Croatia, Ivo Josipovic, should have known
all of this (this alludes to the alleged criminal activities of Mr. Frenkel), yet
still he wrote about Mr. and Mrs. Frenkel as the sincere friends of Croatia.
The rules of investigative journalism allow the media to, through their
activities and gathered information shine the light on certain
events in society, but by publishing these false claims, you, in the harshest
possible way, hurt my client’s dignity, honor and reputation, which are
guaranteed by the Article 35, of the Constitution of the Republic of Croatia, by
the Resolution 428 with the Declaration of Mass Media and human rights as well as
Articles 12, 26 and 27 of the Electronic Media Act (National Gazette »Narodne
novine«, No. 153/2009).
Publishing information you unofficially acquired represents serious violation of
your responsibilities stated in the quoted Electronic Media Act, because all the
information coming from the unofficial source are false.
Also, by stating such harsh and completely unfounded accusations, not only ethics
of a public voice is impaired, but an offense has also been committed that is
listed in Article 199 Paragraph 2, and slander, listed in Article 200, paragraph
2 of the Crime Act (National Gazette "Narodne novine", No 110/97, 27/98, 50/2000,
129/2000, 51/2001, 111/2003, 190/2003, 105/2004, 84/2005, 71/2006, 110/2007 and
152/2008)
There is no doubt that you hurt my client’s, Mr. Aaron Frenkel’s, dignity, honor
and reputation and have caused him immense professional and personal damage so we
demand that you immediately remove the stated post (blog) called "Corruption and
Justice", which contains false information, published on July 7th 2010.
If in the shortest possible time you do not do what we request of you, we inform
you that we will initiate all legal actions against you, for the offense of
slander and insult from Articles 200 and 199 of the Crime Act of the Republic of
Croatia as well as civil proceedings for ensuring compensation as well as
correction of inaccurate information.
